Can HMO be refused? HMO is a different use class.
A normal residential house would be classed as C3 whereas a HMO would be classed as C4.
Say there are many places in the country that you can just apply for this change of use and it is almost just like a notification process.
There are other places that operate under what is called an article 4 directive.
In this scenario, if you don’t have the right process and formula to follow this could be a very costly exercise as you could be refused the change of use.
This comes down to how many existing properties of this type, in the area or on that street. The council will have a threshold that they do not want to pass so that will determine whether they allow the change of use and that particular building.
